These Terms of Sale ("Terms") govern all contractual relations between the Publisher and any individual or entity subscribing to the GoMySeo service available at gomyseo.com.
Definitions
Publisher: Hugo Souliard Lehuby, sole proprietor trading under the name The Ovena, SIRET 989 737 614 00010, 3 Rue des Noyers, 14740 Saint-Manvieu-Norrey, France.
Service: the GoMySeo SaaS (Software as a Service) platform providing SEO analysis, GEO and AEO analysis, local ranking visualization (GBP Heatmap), Google risk audit, keyword research, backlink analysis and optimized content generation, accessible via a web browser at gomyseo.com after authentication.
Client: any individual or entity who has created a GoMySeo account and subscribed to a plan.
Account: the Client's personal space, created upon signup, giving access to the Service based on their available credit balance.
Client Data: all information, content and analysis results generated by or for the Client while using the Service.
Third-Party Data: data from external sources integrated into the Service (DataForSEO, RankParse, Google Maps Platform, Anthropic Claude API, and any other third-party provider) whose availability, completeness and accuracy do not depend on the Publisher.
Credits: a consumption unit specific to GoMySeo, debited each time a paid feature is used, according to the cost defined in Article 3 (base reference rate: €1 = 10 credits). Credits are supplied through the Client's subscription (see Article 3): a set volume of credits is granted at the start of each billing period and does not roll over from one period to the next. Credits acquired before the subscription was introduced, under the former one-time purchase system, remain valid with no expiry date until used up (see Article 5).
These Terms prevail over any other contractual document. Any conflicting terms put forward by the Client are unenforceable against the Publisher. Any subscription implies full and unreserved acceptance of these Terms of Sale as well as the Terms of Use (CGU) available on the site.
Art. 2. Service description and availability
Nature of the service
GoMySeo is SaaS (Software as a Service) software offering a set of tools to support SEO analysis and strategy. Features include: technical and semantic SEO audits, local Google Maps ranking visualization (GBP Heatmap), presence analysis in generative search engines (GEO and AEO), Google algorithmic risk audit, keyword research, inbound link (backlink) profile analysis, and search-engine-optimized content generation.
The Service partially relies on third-party data sources not owned by the Publisher. This data may change, be temporarily unavailable, or be modified independently of GoMySeo, without this engaging the Publisher's liability.
Obligation of means
The Publisher undertakes to implement all reasonable means to ensure the continuity, quality and security of the Service. This commitment is an obligation of means, not an obligation of result. In particular, no guarantee of commercial results, ranking, traffic or SEO performance is granted (see Article 9).
Availability and maintenance
The Publisher strives to maintain an indicative availability rate of 99% per calendar month, excluding scheduled maintenance and force majeure events. This rate is not contractually guaranteed and does not constitute an obligation of result.
Scheduled maintenance is announced at least 24 hours in advance by email or notification in the client area.
In the event of prolonged unplanned unavailability exceeding 72 consecutive hours and attributable solely to the Publisher, a credit or subscription extension may be granted at the Publisher's discretion and upon Client request.
Unavailability related to third-party providers (host, data APIs, Stripe) is not attributable to the Publisher.
Art. 3. Credit pricing and payment terms
Credits subscription system
GoMySeo operates on a recurring credits subscription, billed monthly or annually at the Client's choice. The Client selects a credit tier when subscribing and may change tier or billing frequency at any time (Article 6). The subscription may be cancelled at any time, in a few clicks (Article 5).
The cost of each feature is expressed in credits and displayed on the purchase page as well as in the client area. For reference, the table below shows the cost per analysis at the time these Terms were published. These credit prices may change under the conditions defined in Article 7:

The up-to-date credit-cost table can be viewed at any time on the page gomyseo.com/buy-credits. In case of discrepancy between the table above and the online page, the online page prevails.
Pricing and invoicing
All prices are shown in euros, tax included (TTC). The Publisher operates under the VAT exemption scheme (article 293 B of the French General Tax Code); as such, no VAT is collected or mentioned on invoices while this scheme remains applicable.
Each subscription is a recurring payment: the Client's card is charged automatically at the start of each billing period (monthly or yearly) until the Client cancels (Article 5).
Proof of payment is available in the client area after each transaction.
Business clients wanting an invoice with their VAT number or SIRET must enter this information in their profile before subscribing.
Payment methods
Payments are processed exclusively by Stripe Inc., a PCI-DSS certified payment provider. The Publisher has no access to any of the Client's bank details.
Accepted payment methods: credit/debit card (Visa, Mastercard, American Express).
By subscribing, the Client authorizes Stripe to charge their card automatically and recurrently at the start of each billing period, until the subscription is cancelled.
Each period's credits are added to the Client's account as soon as payment is confirmed by Stripe (usually within seconds).
If a payment fails, the Client is notified and invited to update their payment method; the subscription may be suspended after repeated failures.
Credits already granted are neither refundable nor exchangeable for real currency, subject to the provisions of Article 8.
Art. 4. Free credits at signup
Free signup: every new user automatically receives 10 free credits when creating their account, with no card registration or purchase commitment, and no time limit.
How it works
Upon account creation, the Client automatically receives 10 credits, usable with no expiry date to try the Service's features (audits, analyses, content generation, etc.), according to the credit cost specific to each feature.
No card required at signup. Free credits are added automatically, with no payment details entered and no subscription needed to use them.
No time-limited trial: these 10 credits are not a free trial period with an automatic charge afterwards — they are a one-time signup bonus, usable at the Client's own pace with no deadline.
Once free credits are used up: the Client may keep using the Service by subscribing to a credits plan (Article 3). The account remains active indefinitely, with or without a subscription.
One-time free credits
The 10 free credits are granted once per Client, identified by their email address. Any attempt to create multiple accounts to obtain additional free credits is considered abusive use of the Service and may result in the deactivation of the accounts concerned.
Additional bonus credits
The Publisher may, at its discretion and without contractual commitment, offer additional bonus credits during occasional promotions. These free credits are subject to the same terms of use as purchased credits, but their validity may be time-limited, in which case the validity period is stated at the time they are granted.
Art. 5. Credits subscription — monthly or annual, cancel anytime
No minimum commitment: although it is a recurring subscription, the Client may cancel it at any time, in a few clicks from their client area, in accordance with French law n°2023-590 of June 30, 2023. Cancellation takes effect at the end of the current billing period; no minimum term is imposed.
Nature of the subscription
Each subscription is an open-ended contract, automatically renewed at each period (monthly or yearly, as chosen by the Client), until cancelled by the Client.
Subscription credits are granted automatically at the start of each period, up to the subscribed tier. Credits unused at the end of a period do not roll over to the next period.
To change tier (increase or decrease their monthly credit volume) or billing frequency, the Client cancels their current subscription (see below) and subscribes to the new desired tier — see Article 6.
Using credits
Credits are automatically debited from the Client's balance each time a paid feature is used, according to the cost defined in Article 3.
The available balance is visible at any time in the client area.
If the balance becomes insufficient to run an analysis, the Client is informed and invited to upgrade their tier.
Credits cannot be combined with promotional offers unless the Publisher explicitly states otherwise.
Cancellation by the Client
The Client may cancel their subscription at any time, in a few clicks, from their client area (Stripe billing portal) or by contacting contact@gomyseo.com, in accordance with the French right to cancel online subscriptions in three clicks (law n°2023-590).
Cancellation stops automatic renewal: the Client keeps the benefit of credits already granted until the end of the period already paid for, after which the subscription ends with no further charge.
No pro-rata refund is granted for the current, already-billed period, subject to the provisions of Article 8.
Cancelling the subscription does not delete the Client's account or data. Full account closure may be requested separately at contact@gomyseo.com; data is then retained for 30 days to allow export, then deleted in accordance with Article 12.
Credits acquired before the subscription was introduced
Clients who purchased credits under the former one-time payment system, before the subscription was introduced, keep the full benefit of those credits. They remain valid with no expiry date and usable independently of any subscription, until used up. These credits form a balance distinct from subscription credits and are consumed separately.
Suspension or deactivation by the Publisher
The Publisher reserves the right to suspend or deactivate access to the Service, with or without notice depending on severity, in the following cases:
serious or repeated violation of the CGU or these Terms of Sale;
abusive use of the Service, including attempted circumvention of credit-consumption mechanisms or unauthorized scraping;
providing false information at signup.
If the Publisher suspends the account for Client fault, remaining credits may be permanently lost without refund.
Art. 5 bis. Additional one-time credits, on top of the subscription
In addition to the recurring subscription described in Article 5, a Client with an active, ending, or payment-issue subscription (Article 5) may purchase additional credits for a single one-time payment, to cover a temporary need beyond their subscribed monthly volume. This purchase is not a subscription: it is billed once, with no recurrence, and does not renew automatically.
The Client freely chooses an amount between €5 and €200, at the same base rate as the rest of the Service (1€ = 10 credits, i.e. between 50 and 2,000 additional credits).
This purchase is only offered to Clients who already hold a credits subscription (Article 5); it is not available on its own.
Additional credits are made available immediately upon payment and are added on top of the Client's existing balance (subscription credits and, where applicable, older non-expiring credits, Article 5).
Validity: exactly 1 month from the purchase date of that specific batch of additional credits — independently of the subscription's own renewal date. This exact expiry date is displayed to the Client both before purchase and afterwards, in their client area.
Unused additional credits are automatically and permanently lost at the end of this 1-month period: they are neither refunded, extended, nor converted into non-expiring credits. The Client is notified before this happens.
To limit this loss risk, additional credits are consumed with priority over the Client's older, non-expiring credits (Article 5) whenever a paid feature is used — but after the subscription's monthly credits, which would otherwise be wasted at the next monthly reset regardless.
If the Client purchases additional credits more than once, each purchase forms its own batch with its own expiry date; batches do not merge, and the batch expiring soonest is used first.
By expressly requesting immediate access to these credits, the Client waives their 14-day withdrawal right under Article L221-28 of the French Consumer Code for this purchase, under the same terms as described in Article 8.
Art. 6. Renewal and tier changes
The subscription renews automatically at each billing period (monthly or yearly): the Client's card is charged and the subscribed credit tier is granted, until the Client cancels (Article 5).
The Service does not currently offer an instant tier change with automatic mid-period proration. To switch to a different tier or billing frequency, the Client cancels their current subscription from their client area (Article 5) — they keep the benefit of credits already granted until the end of the period already paid for — then subscribes to the newly desired tier once that period ends.
No double charge can occur: a new subscription cannot be started while a subscription is still active or pending cancellation.
Old one-time-purchased credits (Article 5) are never reset or affected by a tier change: they remain on a separate, non-expiring balance.
Art. 7. Right to modify the offer
The Publisher reserves the right to modify at any time the plans, prices, features, quotas, interface, design or any aspect of the Service, without this constituting a breach of contract. The following conditions apply depending on the nature of the change.
7.1 Non-substantial changes
The following changes are considered non-substantial:
graphic or ergonomic changes to the interface;
addition of new features or extra tools;
improvements to technical performance or security;
change of a third-party provider offering an equivalent feature;
upward changes to quotas.
These changes are applicable immediately, without notice or right to compensation for the Client.
7.2 Substantial changes
The following are considered substantial changes affecting:
the price of subscription tiers (increase in the euro/credit conversion rate);
a significant increase in the credit cost of an existing feature;
the permanent removal of a feature available at the time of purchase.
In these cases, the Publisher notifies the Client by email with 30 days' notice before the change takes effect. Credits already purchased remain usable at the rates in effect when purchased or at the new rates, depending on the change. Continued use of the Service after the notice period expires constitutes full acceptance of the new terms.
7.3 Evolution of third-party data
The Service integrates data from third-party providers (DataForSEO, RankParse, Google Maps Platform, Anthropic Claude API, among others). These providers may change their APIs, pricing or availability independently of the Publisher. Such a change may require the Publisher to adapt certain features or replace a data provider. These adaptations do not constitute substantial changes within the meaning of this article, insofar as they aim to maintain an equivalent level of service.
Art. 8. Right of withdrawal
8.1 Legal principle (individual clients)
In accordance with article L221-18 of the French Consumer Code, clients acting as consumers (individuals) benefit in principle from a 14-day withdrawal period from the conclusion of the contract, without having to justify any reason or pay any penalty.
8.2 Legal exception and express waiver
In accordance with article L221-28 of the French Consumer Code, the right of withdrawal does not apply to digital content and services provided with immediate performance, once the consumer has expressly and previously waived this right.
When subscribing, the Client must check two separate, non-pre-checked boxes. The first constitutes acceptance of these Terms of Sale and the Legal Notice, and acknowledgment that the subscription is recurring: the Client's card will be charged automatically at the start of each billing period (monthly or yearly, as selected) until cancelled, and that the Client can cancel at any time, in a few clicks, with no obligation — subscription credits for the period already paid remain usable until the end of that period. The second is the express waiver of the right of withdrawal for each billing period, worded as follows:
"I expressly request that each period's credits be made available immediately upon payment, and I acknowledge that I am waiving my 14-day withdrawal right under Article L221-28 of the French Consumer Code for each such delivery, since the credits are provided and available immediately."
Without both boxes checked, the payment button remains disabled and no subscription can be started.
8.3 Application to each billing period
The express waiver of the right of withdrawal applies to each billing period of the subscription (monthly or yearly), once the Client has checked the box provided for in article 8.2 and that period's credits are immediately available on their account after payment is validated. As the Service is provided digitally with immediate performance, no refund can be granted under the right of withdrawal for a billing period already charged and whose credits have been granted.
8.4 Business clients
In accordance with article L221-3 of the French Consumer Code, the provisions relating to the right of withdrawal do not apply to clients acting within the scope of their professional activity. No right of withdrawal is granted as a matter of course to business clients.
Art. 9. No guarantee of results whatsoever
GoMySeo is a decision-support tool, not a guarantee of commercial results. No promise of ranking, traffic, position or performance is made or implied by subscribing to a GoMySeo plan.
The Publisher does not guarantee, under any plan or in any respect, the following results:
an improvement in the Client's ranking in search engine results (Google, Bing, DuckDuckGo, etc.);
an increase in organic traffic or number of visitors;
an improvement in visibility in generative search engines (ChatGPT, Perplexity, Claude, Gemini, etc.);
a return on investment, lead generation or revenue;
first position, or any other specific position, in Google Maps or local results.
Use of the Service may result in an improvement, stagnation or decline in the Client's search rankings. These outcomes depend on factors entirely outside the Publisher's control, notably:
search engine algorithms, which may change at any time;
the Client's decisions and actions concerning their site or Google Business Profile listing;
competition in the Client's industry and geographic area;
the quality and relevance of content published by the Client;
technical factors specific to the Client's site or infrastructure.
The Client expressly acknowledges having subscribed to the Service with full knowledge and without relying on any promise of results, implicit or explicit.
Art. 10. Liability and limitation of liability
10.1 Liability cap
The Publisher's total liability under these Terms of Sale, for any cause whatsoever, is capped at the amounts actually paid by the Client to the Publisher during the 12 months preceding the triggering event of the claimed damage.
10.2 Exclusions of liability
The Publisher cannot be held liable for:
indirect, consequential, incidental or intangible damages, notably loss of revenue, loss of clientele, loss of profit, commercial harm or damage to reputation, even if the Publisher was informed of the possibility of such damages;
decisions made by the Client based on data, analyses or recommendations provided by the Service;
changes in the Client's rankings, traffic or search-engine visibility;
inaccuracies, gaps or interruptions in data from third-party providers (DataForSEO, RankParse, Google Maps Platform, Anthropic Claude API, etc.);
service interruptions caused by the host, a third-party provider, a cyberattack, or any force majeure event;
any damage resulting from use of the Service not in accordance with these Terms of Sale or the CGU;
loss of Client data resulting from the Client's own fault or negligence.
10.3 Client liability
The Client is solely responsible for how they use the data, analyses and content generated by the Service. It is up to the Client to verify the relevance of recommendations to their specific situation before making any decision. The Publisher cannot be held jointly liable for the consequences of those decisions.
Art. 11. Intellectual property
11.1 Publisher's rights
The Publisher is and remains the sole owner of all intellectual property rights relating to the GoMySeo Service, notably:
the software's source code and algorithms;
the GoMySeo trademark, logo and associated graphic elements;
the Service's user interfaces, designs, architectures and structures;
technical and functional documentation.
Subscribing grants the Client a personal, non-exclusive right to access and use the Service, for the duration of the subscription and within the applicable quota limits. This right is non-transferable and cannot be sublicensed.
11.2 Client's rights
The Client remains the sole owner of the data they submit to the Service (URLs analyzed, business names, keywords, generated content, etc.). The Publisher claims no ownership right over this data.
The Publisher is authorized to use Client data in an anonymized and aggregated form to improve the Service, without this allowing the Client to be individually identified.
Art. 12. Personal data protection (GDPR)
12.1 Data controller
Hugo Souliard Lehuby, The Ovena, 3 Rue des Noyers, 14740 Saint-Manvieu-Norrey, France, contact@gomyseo.com, is the controller of personal data collected in connection with use of the Service.
12.2 Data collected and purposes
Identification and account data: last name, first name, email address, hashed password. Purpose: creating and managing the client account.
Billing data: name, address, card information (processed and stored exclusively by Stripe). Purpose: contract performance, invoicing.
Usage data: URLs analyzed, keywords entered, queries run, analysis results, history. Purpose: providing the Service.
Technical data: IP address, browser type, connection logs. Purpose: security, abuse detection, service improvement.
Communication data: emails exchanged with support. Purpose: customer service management.
12.3 Retention periods
Active account data: retained for the duration of the subscription.
After termination: data is retained for 30 days to allow export, then deleted. Billing data is retained for 10 years in accordance with legal accounting obligations.
Technical logs: retained for 12 months.
12.4 Subprocessors and recipients
Stripe Inc.: payment processing (bank data). Policy available at stripe.com.
Host (application server): hosting of the Service and data.
DataForSEO, RankParse, Google Maps Platform, Anthropic Claude API: provision of data and third-party analysis services. These providers process only the technical data necessary to perform requests (URLs, keywords).
No personal data is sold, rented or transferred to third parties for commercial purposes.
12.5 Client's rights
In accordance with Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act, the Client has the following rights: access, rectification, erasure, restriction of processing, portability and objection. These rights may be exercised by sending a request to contact@gomyseo.com. A response is provided within 30 calendar days. If dissatisfied with the response, the Client may lodge a complaint with the CNIL (www.cnil.fr).
For any question relating to data protection, see GoMySeo's Privacy Policy.
Art. 13. Security and hosting
The Service is hosted on servers located within the European Union. The Publisher implements the following technical and organizational security measures:
encryption of communications via HTTPS (TLS);
hashing of client account passwords;
access control to data and access logging;
regular data backups.
The Publisher cannot be held liable for a security breach occurring at a third-party subprocessor (host, Stripe, API providers) that has met its own security obligations. In the event of a personal data breach likely to result in a high risk to the Client's rights and freedoms, the Client will be notified as soon as possible, in accordance with article 34 of the GDPR.
Art. 14. Force majeure
The Publisher cannot be held liable for a failure to fulfill its contractual obligations resulting from a force majeure event within the meaning of article 1218 of the French Civil Code, i.e. any unforeseeable, irresistible event external to the Publisher. The following are notably considered force majeure events, without this list being exhaustive:
failure or unavailability of a third-party API provider (DataForSEO, RankParse, Google Maps Platform, Anthropic Claude API, etc.);
failure or unavailability of the host or of the Stripe payment provider;
cyberattack, hacking or distributed denial of service (DDoS);
large-scale network or internet infrastructure failure;
natural disaster, fire, general strike or public-order event;
administrative or legal decision forcing the Publisher to suspend all or part of the Service.
The Publisher notifies the Client as soon as possible of a force majeure event and strives to restore the Service as quickly as possible. If force majeure continues beyond 30 calendar days, the Client may cancel their subscription at no cost.
Art. 15. Changes to these Terms of Sale
The Publisher reserves the right to modify the text of these Terms of Sale at any time. Any change is notified to the Client by email at the address registered in their account, with a minimum notice of 15 days before it takes effect.
The updated version is published at gomyseo.com/cgv.php with an indication of the last-updated date.
Continued use of the Service after the notice period expires constitutes acceptance of the new Terms of Sale. If the Client refuses the new Terms, they have the right to cancel their subscription at no cost before the effective date.
Art. 16. B2B and B2C specific provisions
16.1 Individual clients (consumers)
Individual clients acting outside any professional activity benefit from all protections granted by consumer law, notably the framed waiver of the right of withdrawal for digital content with immediate performance under the conditions of Article 8, and the mediation provisions of Article 17.
16.2 Business clients
Legal entities or individuals acting within the scope of their professional activity acknowledge that these Terms of Sale govern all of their relations with the Publisher, to the exclusion of any other commercial document. They notably confirm:
that they do not benefit from the 14-day right of withdrawal provided for in article L221-18 of the French Consumer Code (article L221-3);
that they do not benefit from the consumer-mediation provisions of Article 17;
that any dispute will be submitted to the competent courts under the terms defined in Article 18.
Business clients with an intra-community VAT number or a SIRET may enter it in their client area to have it mentioned on their invoices. It is up to them to verify the tax rules applicable in their country.
Art. 17. Consumer mediation
This article applies exclusively to individual clients (consumers).
In the event of a dispute with GoMySeo, the Client is invited to first contact the Publisher at contact@gomyseo.com. The Publisher undertakes to respond within 10 business days.
In accordance with the provisions of the French Consumer Code concerning consumer dispute mediation, after contacting us and in the absence of a satisfactory response, you may use a free consumer mediation procedure with:
The mediator must be referred to within one year of the written complaint sent to the Publisher. The mediation procedure is free for the consumer. The Client remains free to accept or refuse the solution proposed by the mediator.
Art. 18. Applicable law and jurisdiction
These Terms of Sale are governed by French law.
Individual clients (consumers)
In the event of a dispute not resolved amicably or through mediation, the competent jurisdiction is the civil court of the defendant's place of residence, in accordance with the territorial jurisdiction rules applicable to consumer disputes.
Business clients
For any dispute between the Publisher and a business client, the parties expressly agree to the exclusive jurisdiction of the Commercial Court of Caen (Calvados, France), notwithstanding multiple defendants or third-party proceedings, including for summary proceedings.
Should any provision of these Terms of Sale be declared void or unenforceable by a competent court, the remaining provisions shall remain in full force. The Publisher and the Client would then undertake to replace the void provision with a lawful provision as close as possible to the parties' original intent.
The fact that the Publisher does not, at a given time, invoke a provision of these Terms of Sale cannot be interpreted as a waiver of the right to invoke it later.
